State Council resolution on the draft of the amended Act on Promotion of Information and Communications Network Utilization and Information Protection for promulgation
The Korea Communications Commission (KCC, Chairman Kim Hong-il) has announced that the proposal to amend the Act on Promotion of Information and Communications Network Utilization and Information Protection has been approved during today's (Jan 16) State Council meeting. This amendment aims to enhance penalties for illegal spam message senders and telecommunications business operators violating obligations to prevent illegal spam message transmissions.
There have been concerns that the level of penalties for violations by profit-oriented advertisers and providers of information and communications services engaging in spam message transmissions is insufficient compared to the benefits they gain from such actions, leading to the continuous production of illegal spam messages.
In particular, the massive dissemination of illegal spam messages not only causes inconvenience to users but also contributes to secondary crimes such as illegal gambling and loans, resulting in significant economic losses for the public and posing serious societal issues.
As part of the approved amendment, the penalties for illegal spam message senders have been strengthened, increasing from imprisonment for up to 1 year or a fine of up to 10 million won to imprisonment for up to 3 years or a fine of up to 30 million won. Additionally, telecommunications business operators failing to take necessary measures against illegal spam messages may face an increased fine, raised from 10 million won to 30 million won.
The legislative amendment, approved in the December plenary session and forwarded to the government, will undergo State Council resolution before taking effect six months after promulgation.
Chairman Kim said, "We will strengthen inspections on illegal spam message senders and operators to ensure strict enforcement of the amended law." He added, "Moreover, we will focus on making multifaceted efforts to eradicate illegal spam messages, including the establishment of a self-regulatory system for the bulk SMS market."
