KCC Vice Chairman Hur Wook meets with EDPB Chair Andrea Jelinek to discuss data protection adequacy assessment


On June 22, Korea Communications Commission (KCC) Vice Chairman Hur Wook visited Austria and met with Andrea Jelenik, chair of the European Data Protection Board (EDPB) and head of the Austrian Data Protection Authority to discuss strengthening Korea-EU cooperation on data protection and future measures for adequacy assessment, as well as request support for Korea's adequacy assessment.

The EU and Korea began preparations for Korea's adequacy assessment at the beginning of last year. The process for an adequacy decision starts with a proposal from the European Commission (EC), followed by an opinion from the EDPB. After deliberation by the Article 31 Committee, comprised of representatives of member states, the last step is adoption of the decision by the European Commissioners. Because the EDPB's opinion on the EC's proposal is binding, cooperation with EDPB in the process of receiving an adequacy assessment is essential.

Before this meeting, Vice Chairman Hur attended the 36th Plenary meeting of the Committee of Convention 108 of the Council of Europe (CoE) in Strasbourg, France to introduce Korea's outstanding data protection legal framework to representatives of the Convention's 51 signatory countries and 27 observer countries. He reinforced Korea's commitment to cooperating with European countries and asked for support for Korea's adequacy assessment.

Additionally, Vice Chairman Hur met with Alexssandra Pierucci, chair of the Committee of Convention 108, and Patrick Penninckx, head of the Information Society at CoE, to explain Korea's personal data protection laws and regulations, including the Network Act, and discuss Korea's current status and forecast for adequacy assessment.

* Note: Established in 1981, Convention 108 is the only binding, international treaty on data protection, and along with GDPR is considered an international model for legal and regulatory frameworks on personal data protection.
